My home sale was supposed to close on September 15. I can honestly say that this buyer has been a nightmare to work with and this closing tops it off. On the 15th his loan papers were not at the title company. On the 16th I got an amendment from him with an extension and new terms to the contract - essentially he was applying for a different loan and all the terms changed. I told him I would not sign this amendment. On the 19th I got another amendment from him, once again an extension and a completely different loan, different terms.
Also, he is telling me that his lender has required a 2 foot board on the back of my house be touched up with paint before the loan can close and therefore it is my fault the loan did not close on the 15th as required and - since he can no longer get the original loan - I HAVE to sign this new amendment with the new loan. Further, he is going to sue ME for his financial expenses due to my not signing the new amendment and not painting the board (which I knew nothing about).
It was my understanding that if the loan doesn't close on time, that both parties have to sign any amendment for extension, and that basically the loan terms shouldn't change, the amount I agree to pay for his closing costs shouldn't change from the original contract. I am in Texas. This gentleman (to use the term loosely) has threatened to drag me through court for the next 2 years. I have already consulted 3 real estate attorneys on this and they have basically told me that the contract is dead, but that anybody can sue anybody and this guy can really do financial damage to me. I am at a loss as to what to do. I don't want to sign this amendment and I really don't want to sell to him anymore. I just want him to go away. It is at this time that I regret not listing with a real estate agent (and no, this is not an advertisement, unfortunately, this is real).
