I feel that buyers' agents complicated the selling of my home more than should have been allowed and that 3% was not earned on their part. It felt like giving them free money.

Buyers agent are to be remembered as just that -- an agent for the buyer. They have no motivation to look out for the sellers interest whether FSBO or represented by an agent. I have even told my buyers that it is great if we find a FSBO because they most likely won't know what they are doing. Not to be mean but truthful. Unless they get a lawyer or have done it several times I assume most of the stuff I write on the contract will go right over their heads. So yes we do kind of complicate things if you were not looking for some of the legal forms, contingencies, and disclosures we are going to coming to the table with.

On the other hand, buyer's agents will most likely be liable if something gets screwed up. Once they get involved they will probably produce all the documents. If something isn't filled out right then the finger can get pointed at them. Most serious would be the lead disclosure and the sellers disclosure. I was a dual agent here on a sale in Blackjack MO which made national news and the ACLU even got involved. I was the one that put the wheels in motion with the press, because I was comfortable with the work I had done to be fair to both sides. I knew my paperwork was in order. Sure enough you never heard my name come up in anything. Well, my seller been a FSBO I guarantee you all cameras and newpapers would have pointed the finger at their lack of disclosure or advising the buyer of occupancy rules.

Sometimes a third party is helpful in keeping the sides objective and from letting emotion get in the way. Also, there is a tendency from a buyer to try to get the seller to leave this / leave that. The buyers agent usually does not get involved in that type of negotation but when building inspections and appraisals come in can be a good tool to keep everyone from choking each other.

I generally charge a lower fee if FSBO just want me to be there as an objective transaction broker. Not representing either side. Everything's negotiable. I always wonder is commission earned by how hard the deal is, how quick it goes, how slow it takes, how much it costs or just the quality of the service. And should I adjust my commission for each ? There are some deals that were charged 3% that if I knew they would have been that much headache in hindsight would have done 10%. But that is the gamble you take. We have no idea if a home is going to take 6 days or 60 days.

[My wife and I have discussed with a few realtors how they would show a FSBO. Most Have stated that alot of realtors wont show a Fsbo Home . And some would not even Negotiate about their fee. We Have had our house on the market FSBO and With a discount realtor. We are in your area code you can also look up my listing as a realtor if you want to show my house just call and Ior my wife will meet you there.font=Verdana][size=5][/size][/font]

Bryan, it seems you're trying to straddle the fence. Generally people who sell FSBO, or by owner, don't have an agent representing them. If you do have an agent represent you, expect to pay the agent a commission for selling your home.
