First of all I really appreciate the forum. It has helped in preparing to list my house. We were listed with an agent for 4 months and our listing has expired. We had plenty of traffic to our house and it never sold. We had some comments from potential buyers about our agent not returning phone calls. We also had 2 open house dates that our agent failed to show and not tell us.

So my question is are we still required to pay her if an previous potential buyer buys our house after seeing it FSBO?

Also would agreeing to use the buyers agent on our new purchase attract more agents?

I believe, but don't quot me that you need to pay her if the buyer had previously seen the home through her

If you are no longer under contract with the agent, then you do not have to pay her. It's the same as if your contract with one agent expired and you hired a different one to sell your house. The current agent working for you would get the comission, not the previous one.

Make sure to read the fine print in the contract that you have with the previous agent. If you get a buyer within the 30days after your terminate the contract, she will be able to get the commission. After the 30days, you don't have to pay her dime. Next time, when you choose a Realtor make sure to ask her/him to give you the option to cancel your contract upon their performance and your satisfaction with  their service. Good luck
